TERMS OF SERVICE AND DATA DISCLAIMER

These Terms of Service (“Terms”) govern your use of Hail Magic (“Hail Magic”, “we”, “us”), including the hailmagic.com website, the web and mobile app (the “App”), subscriptions, add-ons, PDF reports, and meteorologist-verified storm reports. By creating an account, using the App, or completing a purchase, you agree to these Terms and to our Privacy Policy. If you are using the App for a business, you agree on behalf of that business.
1. WHAT HAIL MAGIC PROVIDES
Hail Magic is a storm-intelligence tool for restoration contractors, roofers, insurance adjusters, and similar professionals. Features include live and historical hail swaths and hail tracks, NEXRAD radar and replay, severe-wind swaths, tornado damage tracks, ground reports, alert zones and notifications, a 60-minute hail forecast add-on, roof measurement, address-based hail damage PDFs, swath exports (PDF, CSV, CRM), optional skip-tracing of property owners, team seats, and meteorologist verification services. Features may change, be added, or be removed over time.
2. WEATHER DATA DISCLAIMER (“AS-IS”)
Sources and estimates
Map data is derived from third-party and public sources, including NOAA MRMS radar products (such as MESH and POSH), NWS Local Storm Reports and damage surveys, the Iowa Environmental Mesonet archive, CoCoRaHS observer reports, and Vaisala Xweather. Hail swaths, hail tracks, sizes, wind swaths, and forecasts are computer-generated estimates. Radar-estimated hail size can differ from what fell on the ground, ground reports can be incomplete or mislocated, and historical data does not include every product that is available live.
No guarantee of ground accuracy
A swath, track, or alert at a location does not guarantee that hail fell there, that it was a certain size, or that any property was damaged. The absence of a swath does not mean hail did not fall.
Not an inspection, appraisal, or insurance determination
Nothing in the App — including PDFs, exports, alerts, and roof measurements — is a property inspection, appraisal, engineering opinion, or insurance-claim determination. You are responsible for verifying conditions on-site with qualified professionals before making financial, roofing, construction, legal, or insurance decisions.
Alerts
In-app, browser, and email alerts depend on data feeds, networks, devices, and email providers outside our control. Alerts may be delayed, duplicated, or not delivered. Do not rely on the App for life-safety decisions — follow official NWS warnings.
3. ACCOUNTS AND SEATS
• You must provide accurate information and keep your password secure. You are responsible for activity on your account.
• Each account (seat) is for one person. Signing in on a new device ends the previous session. Sharing logins is not allowed — add a teammate seat instead.
• Account owners can invite teammates on paid seats. Teammates use the owner’s coverage and add-ons; the owner is responsible for teammates’ use and for all charges.
• Coverage is limited to the U.S. states on your plan.
• Beta or comped access may be changed or ended at any time.
4. PRICING, BILLING AND CANCELLATION
Current pricing is shown on our Pricing page and in the App (for example, a monthly base plan including one state, plus monthly charges for additional states, teammate seats, and the Xweather forecast add-on). Subscriptions renew automatically each month until cancelled. Adding or removing states, seats, or add-ons updates your subscription, and Stripe may apply prorated charges or credits. We may change prices with advance notice; changes apply at your next billing period.
Free trial
New accounts get one 14-day free trial covering the states you choose and the Xweather add-on (teammate seats are not included and can be added after the trial). A payment card is required to start. Unless you cancel before the trial ends, your card is charged the regular monthly price on day 15 and every month after. One trial per person, account, and payment card — if a card has already been used for a trial, the subscription starts billing right away. We email a reminder about 3 days before the trial ends.
Cancellation and subscription refunds
You can cancel any time from Profile → Subscription (Stripe billing portal). You keep access until the end of the period you already paid for. We do not give refunds or credits for partial months, unused states, seats, or add-ons, except where required by law.
Meteorologist-verified storm reports
Verified storm reports are a one-time purchase (currently $150) and can be bought without an account. You agree to give an accurate property address, event date or date range, and contact information. If we cannot produce the report (for example, because no qualifying storm data exists for that address and date range), we will refund the full purchase price. Once a report has been delivered, the sale is final. A verified report is a meteorologist’s professional opinion based on available data — it is not a guarantee of damage or of any insurance outcome.
Payment processing
Payments are processed by Stripe and are subject to Stripe’s terms. We do not receive or store your full card number. You authorize us, through Stripe, to charge your payment method for all purchases and recurring fees.
5. ACCEPTABLE USE
You agree not to:
• Scrape, bulk-download, or automatically harvest maps, swaths, tracks, or other data, or resell or redistribute them as a competing data product.
• Reverse-engineer, interfere with, overload, or bypass security, rate limits, or state-coverage limits.
• Misrepresent App output to homeowners, insurers, or others — for example, presenting a radar estimate as a meteorologist-verified finding or as proof of damage.
• Use skip-traced owner contact information or exported leads in violation of telemarketing, do-not-call, anti-spam, privacy, or consumer-protection laws. You are solely responsible for how you contact anyone using data from the App.
• Upload unlawful, infringing, or malicious content through the contact form or other upload features.
We may suspend or end accounts that violate these Terms.
6. THIRD-PARTY SERVICES
The App works with outside services such as Stripe, Mapbox, Vaisala Xweather, Bird (email), and CRMs you choose to connect (JobNimbus, Projul, and others). When you connect a CRM or use skip-tracing, you authorize us to send the related data to that service. We are not responsible for third-party services, their availability, or their terms.
7. INTELLECTUAL PROPERTY AND YOUR CONTENT
The App, its software, design, processed swath and track geometry, PDFs, and branding belong to Hail Magic. We give you a limited, non-transferable license to use them for your internal business, including sharing PDFs and exports with your own customers. Content you submit (addresses, notes, messages, uploaded images) remains yours; you give us permission to use it to provide and improve the service.
8. LIMITATION OF LIABILITY
The App and all data are provided “as is” and “as available”, without warranties of any kind, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Hail Magic and its owner, operators, and data providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business — including losses from relying on swaths, alerts, reports, estimates, or exports, denied or disputed insurance claims, and missed, delayed, or inaccurate alerts. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. INDEMNIFICATION
You agree to defend and indemnify Hail Magic and its owner and operators against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms or the law, or statements you make to customers, property owners, or insurers based on App data.
10. GOVERNING LAW
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction.
11. CHANGES
We may update these Terms. When we do, we change the date above and ask you to accept the new version the next time you sign in. Continuing to use the App means you accept the updated Terms.
